{1:00 minutes to read} The appeal brief has been served and filed, and the attorney listed on the cover of the brief to argue has a conflict or is no longer with the firm. How does one substitute a new attorney? Once upon a time, this was fixed by going to Court and patching the cover to reflect the new attorney who would be arguing before the Court.

As of March 29, 2019, the Appellate Division Second Department has clarified who is considered counsel of record for the purposes of the appeal and how to change counsel of record. The Court has added subsection 670.1(c) to the Court’s local rules.
