{1:02 minutes to read} As of September 2010, appellant briefs must be served and filed electronically.

The New York State Appellate Division, First Department (“AD1”) requires that an appellate brief is fully searchable in PDF-A format. PDF-A format locks the brief and prevents any additional changes to the contents following conversion. 

Here are a few additional AD1 e-filing requirements: 

  • All argument points in your appellant’s brief must be bookmarked.
  • The page and bookmark must appear on the screen when the appellant’s brief is opened electronically.  
  • The rules require the use of a specific naming convention for documents electronically submitted.
  • The record on appeal (PDF file) must not exceed 10 megabytes in size. If over 10 megabytes, it must be filed on CD/DVD.
  • Electronic signatures are permissible.
  • The rules require the inclusion of an anti-virus certification.
