E-filing Expanded in Appellate Division, 1st Department

[1:45 minutes to read] The categories of appeals subject to e-filing in the First Departments is expanding.

In the following case types originating in the Supreme Court, Bronx, and New York Counties beginning on July 15, 2019, e-filing will be mandatory:

  • Medical, Dental, and Podiatric Malpractice
  • Other Professional Malpractice

Additionally, beginning on July 15, 2019, voluntary, consensual e-filing in all other tort matters originating in the Supreme Court, Bronx and New York counties will be permitted by the Court. Consent to the voluntary participation in e-filing must be given by all parties to an appeal.

Expansion of mandatory e-filing in malpractice matters and consensual e-filing in other tort matters is effective as follows:

    • Matters in which notices of appeal are dated
      • on or after July 15, 2019
      • prior to July 15, 2019, and where the appeal will be perfected on or after September 1, 2019. In these matters, compliance with the requirements of 22 NYCRR 1245.3(a) (Entry of Initial Information for Electronic Filing) will be measured from July 15, 2019
    • Appeals on malpractice matters which have already been perfected are exempt from the mandatory e-filing requirements.
