The Benefits of Electronic Briefs (E-Briefs) by Eric Larke

{1:40 minutes to read} Technology has transformed the world around us, making virtually everything interactive. In law, one of the most important consequences of the digital revolution is the electronic brief, or eBrief. Using the interactive Adobe PDF standard, eBriefs are seamless and efficient, gathering all necessary files into one document. Additionally:

  • An electronic brief provides easy and quick access to the case law cited, while allowing dramatically increased ease-of-use with which to navigate the brief for references. This is in stark contrast to submitting a printed brief, which requires that the entire brief itself be available – in addition to all the relied upon authorities and record material.
  • An eBrief can be read on an iPad or even a smartphone. One can quickly link to the case law cited, or even link directly to videos or images in the brief that can have a compelling effect on the viewer.
  • Currently, many courts still rely on paper filings; however, all indications imply that e-briefs have increased use as more judges and clerks become familiar with them.

Given how efficient and time saving eBriefs are, we believe they will be unanimously embraced by the court system in the years ahead. In fact, a growing number of courts are permitting e-briefs to be filed if an attorney or law firm petitions for the ability to file in this manner.
